Accelerated Sewer and Drain LLC – Service Agreement / Terms of Service

This Service Agreement (“Agreement”) outlines the terms and conditions governing services provided by Accelerated Sewer and Drain LLC (“CONTRACTOR,” “we,” “us,” or “our”) to you, the homeowner, property owner, authorized representative, and/or tenant (“CUSTOMER” or “you”). By engaging our services, you agree to be bound by these terms.

1. General Disclaimer & Limitation of Liability

Accelerated Sewer and Drain LLC and its affiliates will exercise reasonable care in providing services and stand behind the quality of our work. However, due to the unknown and often concealed conditions of drain and sewer lines, there are no guarantees or warranties provided specifically for drain cleaning services. Furthermore, we are not responsible for:

  • Any damage to property or losses incurred during or as a result of the services provided, including but not limited to, drain or sewer line cleaning.
  • Breakage of any toilet, P-trap, or fixture while being removed or reinstalled.
  • Damages to property resulting from new or defective replacement parts manufactured by third parties.
  • Water backup or damage, including to ceilings below, that may occur when removing toilets to clean lines, as water can come up from the line.
  • Further damage to existing weak, damaged, or compromised pipes that may occur during the cleaning process.

2. Appointment Times

All appointment times provided are estimated and are not guaranteed. The CONTRACTOR will endeavor to arrive within the estimated timeframe; however, delays may occur due to unforeseen circumstances such as prior job complications, traffic, or emergency calls.

Cancellation Policy & No-Shows:

We require reasonable notification ahead of your scheduled appointment time for any cancellations. If our crew arrives at the scheduled location and the CUSTOMER is a no-show or the service cannot be performed due to CUSTOMER’s absence or unpreparedness, the CUSTOMER may be liable for the full cost of the scheduled service.

3. Customer Rights Regarding Bonds & Insurance

As the homeowner or tenant, you have the right to request that the CONTRACTOR furnish a performance bond and a payment bond. Please note that the CONTRACTOR may require you to pay for the cost of such bonds. You also have the right to request proof of the CONTRACTOR’s liability insurance and workers’ compensation insurance certificates.

4. Site Conditions & Customer Responsibilities

A. Access to Other Properties:

If the CONTRACTOR requires access to properties other than the service address to perform the work, you are responsible for securing permission for such access. You agree to indemnify and hold harmless the CONTRACTOR, its employees, and agents against all claims, actions, and consequences arising from or related to the use of said properties, including but not limited to, damage occurring in the normal course of work (excluding our negligence) and for securing said property and its contents during and after the work.

B. Property Protection:

You are responsible for securing, removing, and protecting all personal property and its contents, including but not limited to, adults, children, animals, cabinets, fixtures, flooring, walls, tiling, carpets, drapes, furniture, and vegetation during and upon completion of work. You are also responsible for protecting any floors, pavement, stairs, and landscaping that could be damaged in or around the work area, including the pathway to and from it. For safety reasons, please secure all pets while our technician(s) are on-site. You agree to indemnify and hold harmless the CONTRACTOR, its employees, and agents against all claims arising out of your failure to do so.

C. Unchosen Options:

If the CONTRACTOR suggests certain options for the work and you choose not to proceed with them, and a subsequent failure or issue is experienced related to the unchosen options, the CONTRACTOR shall be held harmless and assumes no responsibility for such failure or issue.

5. During Service

A. Safety Distance:

For safety reasons, please maintain a distance of at least 10 feet from our technicians and equipment at all times.

B. Ventilation (Indoor Service):

If service is performed indoors, opening a window is recommended to improve ventilation. This can help mitigate potential odors from sewer gas that may arise from the drain.

6. Post-Service Recommendations

The water in your drains naturally contains bacteria and viruses that could be harmful. For your safety and hygiene, the surrounding area that was serviced today should be thoroughly cleaned and disinfected by you following the completion of our work.

7. Unforeseen Conditions

A. Discovery of Concealed Conditions:

If concealed or unknown physical conditions of an unusual nature are encountered at the job site that differ materially from what was visually apparent, you agree to be responsible for such conditions. You also agree to pay for any additional labor or materials required to address these conditions, including repairs to CONTRACTOR’s equipment damaged by such conditions.

B. Indemnification for Unforeseen Conditions:

It is the intent of this provision that you, the CUSTOMER, are responsible for (1) unforeseen and concealed conditions, and (2) circumstances beyond the CONTRACTOR’s control. Accordingly, you further agree to indemnify and defend the CONTRACTOR and all its agents and employees from and against all claims, damages, losses, and expenses, including but not limited to attorney fees, consequential damages, arising out or as a result from the performance of CONTRACTOR’s work involving, affecting, or relating to such unforeseen or concealed conditions regardless of whether such damages are caused in part by CONTRACTOR.

C. Stuck Drain Cleaning Cable:

Any drain cleaning cable that becomes stuck in the line is your responsibility for removal and/or any additional repairs. The CONTRACTOR is not responsible for any damages caused due to a stuck drain cleaning cable.

D. Roof Vent Cleaning:

The CONTRACTOR will not clean any drain or sewer lines through a roof vent if it is deemed unsafe by the CONTRACTOR.

E. Hazardous Sewage Spills:

If a sewage spill is deemed hazardous material, the cost of cleanup is your sole responsibility.

8. Hydro Jetting Risks

Hydro jetting uses high-pressure water to clear drain and sewer lines. Due to the nature of this process, if the line does not immediately open or is severely compromised, there is a risk that water may back up and cause additional water damage to your property. By authorizing hydro jetting services, you acknowledge and accept this inherent risk. The CONTRACTOR is not responsible for any such water backup or additional water damage resulting from hydro jetting.

9. Payment Terms

A. Fixed Contract Price & Service Outcome:

All work is performed on a fixed CONTRACT PRICE, which includes materials, taxes, and labor. The quoted price for services, including drain cleaning, is due regardless of whether the drain line fully opens or not. A detailed breakdown of costs will not be provided.

B. Invoice Delivery & Payment Methods:

Invoices and receipts are sent electronically. You agree to receive them via text message (SMS) or email (upon request). We accept Cash, Check, and most credit/debit cards.

C. Prepayment for Off-Site Responsible Party:

If the owner or responsible party is not on-site to provide immediate payment upon completion, the invoice must be prepaid in full before any services can commence.

D. Due Upon Completion:

Payment for the work described in this Agreement shall be immediately due upon completion of the work, unless explicitly specified otherwise in writing.

E. Canceled or Insufficient Funds Checks:

A fee of $30 or 10% of the check amount, whichever is greater, will be charged for any checks that are canceled or returned due to insufficient funds.

F. No Deductions & Work Stoppage:

No deductions shall be made from payments due to the CONTRACTOR on account of penalties, liquidated damages, back-charges for alleged defective work, sums withheld from payments to other contractors, or the cost of charges or defects in the work. You acknowledge and agree that timely payment for services rendered is an express condition precedent to the CONTRACTOR continuing work as herein described in this Agreement. Failure to make payment when due shall entitle the CONTRACTOR to terminate work immediately. In the event that CONTRACTOR terminates work for non–payment as herein described, CONTRACTOR shall be entitled to all of its reasonable expenses including, but not limited to, cost of labor, materials, a reasonable allowance for overhead and profit, and all other compensation as allowed by law. All warranties will be voided upon termination for non-payment.

10. Services Not Covered

The CONTRACTOR will only perform work and trades specifically outlined in this Agreement. Unless explicitly stated in writing, this Agreement does not cover, and the CONTRACTOR will not perform, work such as carpentry, plaster/wall work, tile work, landscaping, masonry, flooring, roofing, paving, etc. Unless otherwise stated, the repair or restoration of paint, plaster, stucco, and landscaping is your responsibility.

11. Scope of Agreement

This Agreement constitutes the entire and integrated agreement between you, the CUSTOMER, and the CONTRACTOR. It supersedes all prior negotiations, representations or agreements, either oral or written. This Agreement may only be amended by a written instrument offered by the CONTRACTOR and accepted by the CUSTOMER.

12. Definitions

A. “CONTRACTOR”:

Refers to Accelerated Sewer and Drain LLC, and its affiliates.

B. “CUSTOMER”:

Refers to the person or agent for whom the CONTRACTOR is rendering its services.
